Wisconsin releases enforcement actions for March

The Wisconsin Office of the Commissioner of Insurance recently released a list of administrative actions for March.

The actions are issued by OCI when licensing applicants or licensed individuals or companies have violated Wisconsin insurance statutes or regulations. In some cases, the individual or company denied the stated allegations but consented to the action taken.

Any forfeitures paid are deposited in Wisconsin’s Common School Fund administered by the Board of Commissioners of Public Lands. Earnings from the Fund are distributed to all public K-12 schools in the state and are used by school libraries to purchase materials such as books, newspapers, and computers.

Allegations and Actions Against Agents

Theresa A. Buehring, 1610 7th St. S., Wisconsin Rapids, WI 54494, had her insurance intermediary license revoked. This action was taken based on allegations of owing delinquent Wisconsin taxes.

Murat Dorkan, 364 Golfview Rd., Apt. 405, North Palm Beach, FL 33408, had his application for an insurance license denied. This action was taken based on allegations of having administrative actions taken by other states, having been found to have committed an insurance unfair practice or fraud, and using fraudulent, coercive, or dishonest practices in the conduct of business.

Charles Elliott, 18145 K-68 Hwy., Paola, KS 66071, was ordered to pay a forfeiture of $500.00. This action was taken based on allegations of failing to timely disclose an administrative action taken by another state and violating a warning letter issued by OCI.

Jesus Gutierrez, PO Box 1422, Downey, CA 90240, agreed to the issuance of a one-year probationary insurance license. This action was taken based on allegations of having an administrative action taken with regard to an occupational license.

Frank Guzman, 10640 NW 39th St., Coral Springs, FL 33625, was ordered to pay a forfeiture of $500.00. This action was taken based on allegations of failing to timely disclose administrative actions taken by other states and violating a warning letter issued by OCI.

Jontai Holmes, 12750 Citrus Park Ln., Ste. 110, Tampa, FL 33625, was ordered to pay a forfeiture of $500.00. This action was taken based on allegations of failing to timely disclose an administrative action taken by another state and violating a warning letter issued by OCI.

Jordan Ingalls, W2377 Hwy.10, Site 33, Forest Junction, WI 54123, had his application for an insurance license denied. This action was taken based on allegations of having criminal convictions substantially related to the circumstances of holding an insurance license and failing to disclose pending criminal charges.

James Oswald, 4365 SW Bimini Cir. S, Palm City, FL 34990-1348, was ordered to pay a forfeiture of $3,500.00. This action was taken based on allegations of authorizing the use of his NPN by other insurance agents to enroll customers in health insurance plans.

Tristin Palmer, 131 Garrett Rd., Madisonville, TN 37354-6409, agreed to the voluntary surrender of his Wisconsin insurance license. This action was taken based on failing to pay a previous forfeiture when due and failing to respond.

Ronald Paull, 13 Walzer Ln., Scott Township, PA 18433, agreed to a three-year probationary period on his insurance intermediary license. This action was taken based on allegations of a history of administrative actions by the Financial Industry Regulatory Authority and the New York Department of Financial Services.

Benjamin Pfiffner, 1816 Gilkay St., Stevens Point, WI 54481, had his license revoked for three years and was ordered to pay a forfeiture of $5,000.00. These actions were taken based on allegations of making misrepresentations related to the business of insurance and lacking the requisite competence and trustworthiness for an intermediary.

Mary Rogers, 2211 N. 16th St., Milwaukee, WI 53205, had her insurance intermediary license revoked. This action was taken based on allegations of owing delinquent Wisconsin taxes.

Jeffrey Schuur, 3336 France Ave. S., St Louis Park, MN 55416, agreed to surrender his variable life and variable annuity line of authority. This action was taken based on allegations of having an administrative action taken by the Financial Industry Regulatory Authority.

Magdala Sims, P.O. Box 660042, Dallas, TX 75266, had her application for an insurance license denied. This action was taken based on allegations of having administrative actions taken with regard to an occupational license.

Kadian Smith, 2816 Gulfwind Dr. N., Tallahassee, FL 32303, had her application for an insurance license denied. This action was taken based on allegations of having criminal convictions that may be substantially related to insurance marketing conduct and making incorrect or misleading statements on the license application.

Andres Toro, 384 6th Ave., Salt Lake City, UT 84103, had his insurance license revoked. This action was taken based on allegations of failing to pay a previous forfeiture when due, failing to respond, and other insurance violations.

Allegations and Actions Against Companies

Boost Insurance Agency Inc., 85 Broad St., Fl. 17, New York, NY 10004, was ordered to pay a forfeiture of $500.00. This action was taken based on allegations of failing to timely disclose administrative actions taken by other states and violating a warning letter issued by OCI.

Conduent Health Administration Inc., 100 Campus Dr., 2nd Fl., Florham Park, NJ 07932, was ordered to pay a forfeiture of $500.00. This action was taken based on allegations of failing to timely disclose an administrative action taken by another state and violating a warning letter issued by OCI.

Prescryptive Health, Inc., PO Box 403, Redmond, WA 98073, agreed to the issuance of their Pharmacy Benefit Manager (PBM) license. Prescryptive agrees that this stipulation is made without reservation and constitutes a waiver of valuable rights.

Table Bay Financial Network, Inc., 501 W. Broadway #A343, San Diego, CA 92101, had their intermediary firm license revoked. This action was taken based on allegations of failing to respond and failing to pay a previous forfeiture when due.
